New York child support at a glance
- Guideline model: Percentage of combined parental income (the Child Support Standards Act)
- Income used: Gross income as reported, or as should be reported, on the federal tax return, minus listed deductions such as FICA and New York City or Yonkers income tax (Family Court Act §413).
- Percentages: 17% of combined parental income for one child, 25% for two, 29% for three, 31% for four and no less than 35% for five or more. The total is split between the parents in proportion to their incomes.
- High incomes: The percentages apply to combined parental income up to $193,000 (raised from $183,000 on March 1, 2026). Above that, the court may apply the percentages, the statutory factors or both.
- Shared parenting time: Not set out as an overnight threshold in the statute we reviewed; ask counsel how shared custody is treated in your case.
- When support ends: Parents are chargeable with support of a child under 21 (Family Court Act §413).
